Competences of Prešov Self-governing Regions

Conversion of competences on self-governing regions concerns these areas (Act no 416 / 2001):

• ground communications
• rails
• road transport
• civil defense
• social help
• education
• sport
• theatre
• museums and galleries
• enlightenment activities
• libraries
• health service
• human pharmacy
• regional development
• travel and tourism

A) Ground communications:

1. planning, preparation and construction of roads in ownership of self-governing regions according to state conception of highways and priorities of road policy and development of road economy,
2. providing information and basic documents concerning planning, preparation and construction of roads in its ownership for the purposes of cost free creation of state conception of highways and roads for Ministry of transport, posts and communications of SR (Ministry),
3. providing summation of road transport in its ownership during period of state summation, in its own name and own costs,
4. providing information concerning road negotiability to Ministry, including information concerning technical evidence of roads and local communications in its ownership,
5. providing constructional and technical equipment for roads in its ownership according to the needs of state and defensive purposes

B) Rails:

1. discussion of draft road regulation and draft amendments to it together with rail-operator before its publication ,
2. area of competences of rail-administration office
3. realization of state administration concerning tramcars and trolleybuses,

C) Road transport:

1. granting and taking away of road licenses for national regular bus transport,
2. approval of road regulations of national bus transport
3. striking of contracts of actions of public interest with transport operators, and providing compensation of a loss or parts of it or other accounts for transport operators,
4. realization of professional control over road transport in region, if it concerns regular bus transport,
5. penalization of transport operators, if it doesn´t concern regular bus transport,
6. evidence of transport operators, to whom region has given transport licenses,
7. providing information to common informative system in road transport concerning national regular bus transport,

D) Civil defense:

1. collaboration
   1 .1  collaboration during creation of territorial analysis for the purposes of potentional vis major events
   1. 2   during planning and realization of evacuation, coordination, preparation of public for self-defense and common help of towns/units,
   1. 3  during preventive, educational and propagandistic activities of civil defense,
2. realization of imperative documentation of civil defense and taking part in creation and realization of tasks of integrated defensive system,

E) Social help:

1. providing social care in institutions of social services (shelter of social care for children, where social services are provided weekly, for adults, where care is provided yearly and weekly, institutions of protective accommodation, shelter for lonely parents, stations of care services, institutions of nursing care, harborage, rehabilitation centers, shelters of social services for children, where social care is provided daily)
2. creation and publication of social service conception, conception of social prevention and social consultation in its area,
3. making decisions
   3.1 concerning providing care services and its costs
   3.2 concerning providing transport services and its costs
   3.3 concerning providing care in institutions of social services, that has been founded by region as its organization units, termination of these provisions and costs for these services
   3.4 concerning obligation of citizens to pay costs of provided social care, that was provided without legal reason, without payment or at lower cost,
   3.5 concerning obligation of citizens to pay costs of transport service provided without legal reason, without payment or at lower price,
   3.6 concerning obligation of citizens to pay costs of provided care in institution of social services in its area, if the care was provided without the legal reason, without payment or at lower price,
   3.7 concerning obligation to pay costs of provided social care in institutions, that have been created in its competency as its organization units and the high of costs, if there is no common agreement,
   3.8 concerning taking social service away, ceasing of it, increase or decrease the costs of it and refusing the payments
   3.9 concerning refusal of application of corporations and persons for registration that is needed for providing social care,
   3.10 concerning cancellation from relevant register of a subject providing social aid
   3.11 concerning restriction of providing social aid,
4. making decisions on the appeal degree, where the fist degree decision has been made by institution of social services, founded by region as a budgetary or subscription organization
5. making agreements concerning
   5.1 payments for provided social service provided by institutions of social services founded by region as its organization unit
   5.2 amount of more food provided by the institution founded by it as its organization unit
6. administrates register of institutions
7. making agreements concerning providing financial subscriptions to pay the costs for provided social service, prevention, consultation or selected activities of social defense, subscriptions provided to towns/units and purpose bounded subscriptions,
8. control of
   8.1 quality of providing social service or social consultation, of social prevention or selected activities of social defense
   8.2 management of financial subscriptions given to the subject, that provides social care according to this act, control of towns/units and management of single purpose bounded subscriptions
9. creation of measures to eliminate defaults founded during control mentioned above
10. creation and publication of conception of social services in its territory
11. administration of evidence of institutions providing social services in its territory
12. coordination of activities of towns/units and other corporations and persons connected to social care services,
13. organization of educational and recreational camps for children
14. organization of public catering

F) Territorial planning:

1. acquisition of basic documents for territorial planning and territorial documentation of region
2. field of competency of body responsible for territorial planning,
3. approval of basic documents necessary for creation of territorial plan of region
4. approval of territorial plans of regions and announcement of its obligatory parts

G) Education:

1. creation and abrogation of schools and school institutions (secondary schools, schools, centers of training education, interest-educational institutions except language schools founded by primary schools, primary art schools, boarding houses, institutions providing school catering, training education, centers of school services, camps in nature)
2. appointment and designation of school directors
3. administration of schools and school institutions created by it and providing necessary equipment to realize educational processes
4. control of school management with financial resources and equipment given to them by region and control of effectiveness of school management with estate of self-governing region in administration of schools and school institutions
5. allocation of financial resources to private secondary schools, religious secondary schools and control of management with these financial resources
6. provision of school catering and accommodation for pupils and students in schools and school institutions
7. realization of administration in appellate degree concerning matters of schools and school institutions founded by region
8. identification of a school or school institution, that would replace the abrogated one
9. processing and providing of information in the area of education in its competency
10. approval of agreements concerning rental of school buildings and relevant places, that are founded by it

H) Sport:

1. directing administration realized by towns/units
2. elaboration of conception of development in sports for the conditions of self-governing regions

I) Theatre:

1. creation, foundation, fusion and abrogation of professional theatres 
2. encouragement of selected areas of theatre activities in the form of purpose bounded financial injections
3. control of management and efficiency of invested financial resources in theatres founded by it

J) Museums and galleries:

• creation, foundation, fusion and abrogation of regional museums and galleries

K) Enlightenment activities:

1. creation, foundation, fusion and abrogation of enlightenment institutions in the field of competency of self-governing region
2. providing and coordination of enlightenment activities through enlightenment institutions founded by it
3. establishment of selected enlightenment institutions providing specialized consultations , methodical and information-documentary activities for enlightenment centers in the territory of region,

L) Libraries

• creation, foundation, fusion and abrogation of regional libraries,

M) Health service:

1. foundation of policlinics and hospitals with policlinics of II. category
2. direction of register of health-care institutions
3. issuing of allowances for providing of health care in these non-state health care institutions:
   3.1 hospital premises, including stations of pharmacy services of first aid and hospital premises in the institutions of social services
   3.2 specialized institutions of ambulance care
   3.3 agency of domestic care services
   3.4 dialysis center
   3.5 policlinics
   3.6 independent arrangement of common examination and health care processes
   3.7 hospitals of I. category
   3.8 hospitals with policlinic of I. category
   3.9 hospitals with policlinic of II. Category
   3.10 sanatoria for long-term patients
   3.11 geriatric center
   3.12 hospice
   3.13 psychiatric sanatoria, psychiatric hospital and centers for drug-addicted persons
   3.14 stomatology techniques, if region is not its founder
4. making decisions about appeals against decisions of administrative leaders of health care institutions
5. making decisions about obligation of health care institutions to provide health care for a person, that refused proposal for a contract concerning providing health care or in the case of avoiding this contract for the reason of change of specialized orientation of health care institution or working congestion
6. providing representation, if it is necessary to provide health care in other state health care institution
7. creation, foundation and administration of secondary health care schools
8. collaboration on prevention programs

N) Human pharmacy:

1. coordination and vocational direction of activities in the field of human pharmacy
2. issuing of allowances for public pharmacies, branches of it and institutions specialized to provide health care equipment
3. control of providing pharmacy service
4. approval of service timing for public pharmacies, its branches and institution specialized to provide health care services
5. organizing of providing emergency services in public drug stores
6. control in public drug stores, in its branches and in institutions specialized to provide health care equipment
7. making decisions concerning usage of reserves of drugs and health care equipment
8. providing information to health care institutions concerning lack of quality of drugs and health care equipment, concerning suspension of drug registration and/or retirement of drugs and health care equipment
9. deciding stimuli and complaints

O) Regional development:

1. realization of strategy of regional development
2. coordination of tasks concerning providing social and economic development of territory
3. coordination realization of concepts of development of self governing regions
4. providing basic documents, information, numerical information, analysis and evaluations for state organizations and towns/units

P) Travel and tourism:

1. coordination realization of concepts and tasks related to development of trade and tourism
2. providing basic documents, information, numerical information, analysis and evaluations for state organizations and towns/units
